Cancellation and Refund Policy

1. General Information

This Cancellation and Refund Policy governs the cancellation and refund conditions for software development, digital design, consulting, and other technology services provided by BİSTE BİLİŞİM TEKNOLOJİ YAZILIM TASARIM SANAYİ VE TİCARET LTD. ŞTİ. ("BisteSoft").

2. Scope

This policy applies to all services and digital products purchased through the BisteSoft website or through direct communication channels.

3. Right of Withdrawal

In accordance with the Consumer Protection Law No. 6502 and the Distance Contracts Regulation, the consumer has the right to withdraw from the contract within 14 (fourteen) days from the date of establishment of the contract, without stating any reason and without paying any penalty.

However, the right of withdrawal cannot be exercised in the following cases:

• Services whose performance has begun and been completed with the consumer's approval within the withdrawal period
• Software and digital products that are specially produced in line with the consumer's requests or clearly personal needs
• Intangible goods that are instantly performed or delivered in digital media and have been delivered to the consumer
• Custom-developed software projects whose source code has been delivered to the client

4. Refund Process

In cases where the right of withdrawal is valid, the refund process is carried out as follows:

• You must submit your withdrawal request in writing to info@bistesoft.com
• Your request will be evaluated within 10 (ten) business days at the latest
• Once the refund is approved, it will be processed within 14 (fourteen) business days depending on your payment method
• Payments made by credit card are refunded to your card by the relevant bank

5. Partial Refund

If part of the service has been performed and the right of withdrawal is still valid, the remaining amount is refunded after deducting the fee for the performed part. The calculation of partial refunds is based on the project completion percentage and labor expended.

6. Non-Refundable Cases

Refunds are not made in the following cases:

• Completed and delivered software projects
• Projects whose source code and access credentials have been transferred to the client
• After consulting and training services have been completed
• Products developed and delivered upon the client's special request
• Requests made after the withdrawal period (14 days) has expired

7. Dispute Resolution

In disputes regarding cancellations and refunds, an amicable resolution will be sought first. If a resolution cannot be reached, Consumer Arbitration Committees and Ankara Consumer Courts shall have jurisdiction.
